Terms of Service

These Terms govern your access to and use of BirchSight(the “Service”). By creating an account, connecting a Google or Jobber account, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. The service

BirchSight reads work-order notification emails from Property Meld in a Gmail inbox you connect, extracts structured work-order details, and creates or updates matching jobs in a Jobber account you connect. The Service may also reply to the originating email thread with status updates that mirror milestone changes in Jobber.

2. Accounts and eligibility

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for activity in your account and for keeping credentials secure.
• You agree to provide accurate information and to keep your account information current.

3. Connected accounts

The Service requires OAuth access to a Google account (Gmail) and a Jobber account. By connecting these accounts you authorize BirchSightto access and modify data within those accounts solely as described in the Privacy Policy. You may revoke access at any time via the relevant provider’s settings.

4. Acceptable use

You will not:

• Use the Service to violate applicable law, infringe third-party rights, or process data you do not have authority to share.
• Reverse-engineer, scrape, or attempt to extract source code or underlying models.
• Use the Service to send unsolicited communications or to circumvent recipient-allowlist or anti-spam protections.

5. Service availability

The Service is provided on an “as is” basis. We make reasonable efforts to maintain availability but do not guarantee uptime or error-free operation, and we may modify, suspend, or discontinue the Service or any feature with notice when reasonably practicable.

6. Fees

Fees, if any, are described at the time of subscription. The Service may be offered free of charge during early access; we will provide notice before introducing paid fees applicable to your account.

7. Termination

You may stop using the Service at any time by disconnecting your Google and Jobber accounts and deleting your BirchSight account. We may suspend or terminate access for breach of these Terms or for suspected abuse. Sections that by their nature should survive termination (e.g. limitations of liability, governing law) will survive.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. BirchSight’s aggregate liability arising out of or relating to these Terms or the Service will not exceed the amounts you paid BirchSight in the twelve months preceding the event giving rise to liability, or one hundred U.S. dollars (US$100), whichever is greater.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
